Return Policy
Last updated: 2026. Applies to all purchases from Used ATM Machine, operated by Empire ATM Group.
1. All sales are final
All equipment, parts, and accessories sold through Used ATM Machine are sold “as-is, where-is,” and all sales are final. We do not offer refunds, returns, exchanges, or cancellations as a matter of right. Any accommodation is made solely at the discretion of Empire ATM Group on a case-by-case basis, and providing one accommodation does not obligate us to provide another.
2. Condition & “as-is” disclaimer of warranties
Most items we sell are used, refurbished, or open-box. They may show cosmetic wear and are not represented as new unless expressly stated. To the fullest extent permitted by law, Empire ATM Group disclaims all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. No statement, description, photo, or advice — whether given verbally or in writing — creates a warranty.
3. Inspection at pickup (pickup is your acceptance)
The majority of our products are pickup only. You are encouraged to fully inspect and test any item at the time of pickup. By taking possession of an item, you accept it in its then-current condition and acknowledge that it meets your expectations. Risk of loss and title pass to you at the moment of pickup.
4. Shipped items
Where shipping or freight is offered, risk of loss passes to you when the item is handed to the carrier. Inspect your shipment immediately on arrival. Any claim for visible shipping damage must be noted with the carrier at delivery and reported to us in writing within 48 hours, with photographs. Freight and shipping charges are non-refundable, and you are responsible for filing any carrier claim.
5. Case-by-case exceptions
We handle every issue individually. If — at our sole discretion — we authorize a return, the following apply: (a) you must request and receive written authorization before returning anything; (b) the request must be made within 3 business days of pickup or delivery; (c) the item must be returned in the same condition in which it left us, complete with all parts and packaging; (d) a restocking fee of up to 35% may apply; and (e) you are responsible for all return shipping, freight, and handling. Unauthorized returns will not be accepted and may be refused or discarded.
6. Non-returnable items
Regardless of the above, the following are never eligible for return: parts, components, consumables (e.g., paper, ink, cassettes, locks, keys), clearance or “as-is” items, special orders, and any item that has been installed, used, modified, opened beyond inspection, or is missing components.
7. Your responsibilities
You are solely responsible for confirming that an item fits your needs before purchase, including compatibility, size, power and connectivity requirements, software and EMV status, processing activation, licensing, permitting, installation, and compliance with applicable laws and regulations. Empire ATM Group is not responsible for a product’s ability to be activated, processed, certified, or connected to any network or processor.
8. Refunds
In the rare event a refund is approved, it will be issued to the original payment method for the item price only, less any restocking fee and any non-refundable charges (including original and return shipping, freight, and payment-processing fees). Deposits are non-refundable.
9. Chargebacks
If you have a concern, contact us first — we work with our customers. Initiating a chargeback or payment dispute before contacting us is a breach of this policy, and you agree that this policy and your acceptance of the item at pickup or delivery are a complete response to any such dispute.
10. Limitation of liability
To the fullest extent permitted by law, Empire ATM Group’s total liability for any claim relating to a product or order is limited to the amount you paid for that item, and we are not liable for any indirect, incidental, consequential, or lost-profit damages, including lost revenue from equipment downtime.
11. Governing law & changes
This policy is governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Empire ATM Group may update this policy at any time, and the version in effect at the time of your purchase applies. This policy is in addition to, and does not limit, any rights reserved to Empire ATM Group elsewhere in our terms.
